How Mediation Works

Mediation is a voluntary, confidential process whereby a neutral third person called a mediator acts to facilitate and support the resolution of a dispute between two or more parties. Mediation is an informal and non-adversarial process, with the objective of helping the disputing parties reach a mutually acceptable and voluntary agreement. Parties are able to come to an agreement on division of asset, spousal support, child custody/co-parenting, and anything else the parties might need to resolve.

The role of the mediator includes, but is not limited to:

  • Assisting the parties in identifying issues

  • Fostering joint problem solving

  • Enhancing communication, and

  • Exploring settlement alternatives

In Mediation, decision-making authority rests with the parties. A mediator is not allowed to decide who is right or wrong or to tell you how to resolve your dispute.  In mediation, you can try to find solutions that make sense to you and the other person in the dispute to resolve some or all of your concerns.

Mediation Services are offered virtually in an online secure platform from our private Zoom Meeting Room. Virtual Mediation Sessions allow individuals to mediate from the safety and security of their own home as well as provide a confidential and affordable format for those who may be miles apart or simply down the street from one another. The Zoom platform is simple and easy to use and allows all parties' to see and hear each while also having the flexibility to share documents or forms on screen for ease of discussion or review.

After a successful mediation, the parties will have a written settlement agreement they can sign and submit to the court for approval. If the mediation doesn’t result in agreement, the parties can still go to court and litigate their case. Even if the case wasn’t resolved in mediation, the parties likely have eliminated or narrowed some of the issues and have a better understanding of their areas of disagreement.
